Non-agri GIs – is the EU-commission trying to solve a problem that does not exist?

The Confederation of Swedish Enterprise is concerned that a harmonized protection of non-agri GIs within the EU will solve a problem that does not exist.

By the end of 2020, the European Commission opened two roadmaps. One roadmap concerned harmonization of geographical indication protection for non-agricultural products. The other one concerned a review of the design protection. The feedback period closed in the middle of January.

The Confederation of Swedish Enterprise is concerned that a harmonized protection of non-agri GIs within the EU will solve a problem that does not exist. Trademark protection can be used in the existing system. In rules on marketing misleading on the origin of a product is not allowed, even if the type of product is not protected under the rules on GIs.
