This session will examine how patentability is determined for foundational AI inventions, with particular attention to the approach taken in Europe. Members of the Boards of Appeal for Computer-Implemented Inventions (CII) will participate, offering the audience valuable insights into the factors and considerations that influence patentability determinations at the European Patent Office (EPO).
Following this, Professor Noam Shemtov will broaden the discussion by introducing comparative perspectives from other jurisdictions, including South Korea, Japan, China and the United States. This comparative framing will highlight similarities and divergences in global approaches to AI-related patentability, thereby providing participants with more nuanced understanding of the international landscape.
